Privacy Policy

This privacy policy (Privacy Policy) is intended to help users, clients, and the general public (you or your) understand how SKYLD LLC and its related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)) (collectively, Skyld, we, us or our) collects personal information and endeavours to keep the information collected secure.

This Privacy Policy sets out how we protect the personal information that we collect and process, and what options are available to the users of our websites, our clients and general public should they wish to update, access or delete their personal information.

This Privacy Policy applies to all information collected by Skyld, our officers, employees, and contractors through its branches, brands, content, websites, applications, advertisements, technologies, products and services (collectively, Services) from our clients, website users, job applicants, and the public in general.

COLLECTION AND USE OF INFORMATION

Personal information collected by Skyld

‍

Skyld keeps personal information that is provided to us from our website users, clients, job applicants and the general public. Personal information means information or an opinion about an identified person, or a person is reasonably identifiable:

(a) whether the information or opinion is true or not; and(b) whether the information or opinion is recorded in a material form or not. The kind and type of personal information that we collect will depend on how you interact, communicate, or engage with us. We set this out in more detail below. We only collect personal information that is reasonably necessary to carry out our functions and activities.

Given the nature of our Services, it is impracticable for us to communicate with you if you have not identified yourself or used a pseudonym instead of your real name.

  • (a) For clients: A database is kept for all client inquiries about work that has been, is currently being, or will be performed by Skyld. The personal information is kept by Skyld to properly document all inquiries. Skyld keeps the following personal information:
    • (i) the name of the client (Corporate/Business/Association/Partnership Name);
    • (ii) the name of the contact person of the client;
    • (iii) the email addresses linked to the client;
    • (iv) the phone numbers associated with the client;
    • (v) the tasks and scopes of work being performed for the client; and
    • (vi) the postal address of the client.
  • (b) For job applicants: Skyld’s recruitment department collects personal information on all job applicants in relation to a past, present or future job placement. The following personal information is kept by Skyld:
    • (i) the name of job applicant;
    • (ii) the email address of the job applicant;
    • (iii) the phone numbers associated with the job applicant; and
    • (iv) other personal information contained in the job applicant’s curriculum vitae or resume.
  • (c) For all users, clients, and job applicants: Skyld may collect personal information from analytics, cookies, tracking, and similar technologies. This personal information may be collected from data collection technologies to allow Skyld to understand your activity on and off our Services, collect and store personal information when you interact with services we offer, and to analyse and improve the performance of Skyld’s Services. Any personal information collected using data protection technologies will be dealt with in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (Privacy Act).

Personal information may be collected using data collection technologies from:

  • (i) accessing our Services where our data collection technologies (cookies, development tools, and other technologies) are present;
  • (ii) devices that you use to access our Services;
  • (iii) data on your usage of our Services, as well as browsing behaviour and analytics; and
  • (iv) third party providers. Personal information may be supplied from Skyld’s current clients, affiliates in relation to new clients, and Skyld employees in relation to job applicants. Skyld may collect personal information received from these sources.

Use of the personal information collected by Skyld

‍

  • (a) For clients: Skyld shall use the personal information provided by clients to provide the Services requested by the clients. The personal information provided will only be used for purposes reasonably necessary to deliver or enhance Skyld’s Services. If a client decides not to continue using our Services or terminate the Services offered by Skyld, the personal information shall be removed and deleted from Skyld’s database after two (2) years from the cessation, non-continuance, or termination of the contract, unless otherwise requested by the client.
  • (b) For job applicants: Skyld shall use the personal information provided by job applicants for recruitment and employment purposes. All personal information provided shall remain privileged and confidential. If the job applicant becomes an employee of Skyld, the personal information shall remain with Skyld as part of its employee records and will be stored for two (2) years after the termination or cessation of their employment with Skyld, unless otherwise requested by the job applicant/employee. If the job applicant is unsuccessful in obtaining employment with Skyld, the personal information provided, including the job applicant’s curriculum vitae or resume, shall remain with Skyld for potential future job opportunities. The personal information shall only be deleted and removed from Skyld’s records after two (2) years following Skyld determining that the job applicant is not suitable for a position with us, unless otherwise requested by the job applicant.
  • (c) For all users, clients and job applicants: Personal information received from clients, applicants, or users shall also be used by Skyld as a means of contacting them via telephone call, email, SMS message, automated calls or messages or through Skype or other electronic means. Skyld will only use your personal information for direct marketing purposes where you have opted-in for Skyld to provide direct marketing communications. You may ask us to stop sending direct marketing communications to you at any time, including by clicking on the unsubscribe button link in a marketing email sent by us. You may also contact our Data Privacy Officer at contact@skyldglobal.com to opt-out of any direct marketing communications.

Skyld reserves the right to use and/or transfer the personal information received to another country:

  • (i) when a user, client or job applicant contacts Skyld through our website, via email, telephone, online chat, or any other means of communication; and
  • (ii) for the purpose of presenting a job applicant to a client and assigning the job applicant to the client.

DISCLOSURE OF PERSONAL INFORMATION

‍

Skyld may disclose your personal information:

  • (a) to the following parties to provide our Services:
    • (i) external service providers and/or contractors;
    • (ii) anybody who represents you;
    • (iii) companies that provide information and infrastructure systems to us; and
    • (iv) investors, agents, advisers, or any entity that has an interest in Skyld’s business;
  • (b) with your express consent to a client or third-party user;
  • (c) in response to legal processes and legal requests, including subpoenas, court and executive orders, or other orders from any tribunal, judicial or quasi-judicial bodies under applicable law;
  • (d) to enforce policies and agreements entered into by Skyld, subject to your written approval; and
  • (e) when:
    • (i) there are valid claims or allegations that any content violates the rights of third-parties;
    • (ii) there is a suspected activity that is unlawful, illegal, or unethical; or
    • (iii) otherwise when establishing or exercising Skyld’s legal rights or defending against legal claims.

In disclosing your personal information, Skyld will take reasonable steps to ensure that the personal information is treated securely and any disclosure complies with the Australian Privacy Principles set out in the Privacy Act.

DELETING OR OBTAINING COPY OF PERSONAL INFORMATION

‍

Any and all personal information obtained from our clients, job applicants or website users shall be automatically deleted after a period of two (2) years from the acquisition of the Service, termination of the Service, application of the job applicant, or termination of the contract of the job applicant (as the case may be). The provider of the personal information may also request that the personal information be deleted or removed from Skyld’s records and database.

Should you wish to have your personal information and data corrected, removed or deleted from our records and database, you may do so by sending a request addressed to our Data Privacy Officer at contact@skyldglobal.com.

The Data Privacy Officer shall attend to your request on a confidential basis within thirty (30) days of the request being received. Any deletion request will only be undertaken to the extent that is no longer necessary to retain the personal information for our legitimate business purposes or legal or contractual record keeping requirements worldwide. If your deletion request is refused, Skyld will write to you to explain the reasons for our refusal.

You may request a copy of the personal information that you have provided to Skyld. You may do so by sending a request addressed to our Data Privacy Officer at contact@skyldglobal.com.

PERSONAL INFORMATION SECURITY, STORAGE AND RETENTION

Skyld shall take all reasonable steps to keep all personal information as secure as possible and protect it from misuse, interference, loss, or unauthorised access, modification, or disclosure. Without limitation, registration information is not accessible over the internet, but only from a secure password-protected internal workstation. The personal information provided to Skyld is of paramount importance. All personal information supplied is encrypted and remains confidential, private, and secure.

Skyld follows the strict standards laid down by applicable data privacy laws and regulations in the regions where we operate, including the Privacy Act (Applicable Data Privacy Laws), as well as the strict standards of ISO 27001 through the adoption of a company-wide Information Security Management System (ISMS) to ensure information security is at the forefront of all aspects of its global operations.

However, Skyld also recognises that no method of transmission over the internet or electronic storage is 100% secure, Skyld cannot absolutely guarantee its absolute security, but instead shall take all reasonable precautions and measures to prevent information from being disseminated to the public.   • (a) For clients: Our clients’ personal information shall be retained for as long as necessary to provide the Services requested by the relevant client and thereafter for a period of two (2) years from the cessation, non-continuance, or termination of the contract, unless otherwise requested, in compliance with the Applicable Data Privacy Laws where its offices are registered.
  • (b) For job applicants: Our job applicants’ personal information shall be retained for as long as necessary for job application purposes and thereafter for a period of two (2) years after the termination or cessation of the relevant job applicant’s employment with Skyld or following Skyld determining that the job applicant is not suitable for a position with us (as the case may be), unless otherwise requested, in compliance with the Applicable Data Privacy Laws where its offices are registered.
  • (c) For all users, clients, and job applicants: Personal information shall be retained for as long as necessary for the purposes for which it was provided and thereafter for a period of two (2) years, unless otherwise requested, in compliance with the Applicable Data Privacy Laws where its offices are registered.

QUALITY AND CORRECTION OF PERSONAL INFORMATION

‍

Skyld shall ensure the accuracy, completeness, relevance, and quality of the personal information collected from you. If there are changes, corrections or amendments to your information or if you wish to request to delete or remove the information from our database, please contact our Data Privacy Officer at contact@skyldglobal.com.

SENSITIVE INFORMATION

‍

Skyld does not collect information revealing the following information considered sensitive information under the Privacy Act:

  • (a) race, ethnicity, marital status, age, and religious, philosophical, or political affiliations;
  • (b) health, education, genetic or sexual life or predisposition, offence committed by any individual; and
  • (c) government-issued information, social security numbers, licenses, previous health conditions, tax returns.

Skyld may, however, request the sensitive information from its job applicants. In this regard, Skyld may only collect such sensitive information after the job applicant gives their express consent for purposes of job applications only, or where required or authorised by an Applicable Data Privacy Law. We will not adopt, use, or disclose any government-issued identifiers provided by you unless we are allowed to do so under the Australian Privacy Principles. Any sensitive information provided shall be retained for as long as necessary for job application purposes and thereafter for a period of two (2) years, unless otherwise requested by the job applicant.

USE OF NON-PERSONAL INFORMATION

Testimonials or feedback provided to Skyld may be used by Skyld for training, marketing, or any other purpose at Skyld’s sole discretion. You acknowledge and agree that any feedback you provide may be shared with third parties through social media and other associated programs or applications.

All proprietary rights over the information, data and opinions made by testimonials, complaints or feedback are deemed relinquished and ceded to Skyld.

If you would like us to delete or update your testimonial or feedback, you may do so by informing our Data Privacy Officer at contact@skyldglobal.com.

GDPR

The European Union General Data Protection Regulation (GDPR) provides people based in the European Union with additional rights and protections concerning the personal information we collect. If you are based in the European Union, and have a complaint about Skyld’s collection, maintenance or use of your personal information relating to application of the GDPR, please contact our Data Privacy Officer at contact@skyldglobal.com.

AGE RESTRICTIONS

Skyld’s services are available for those over 18 years of age. Skyld’s services are not targeted to, intended to be consumed by or designed to entice individuals under the age of 18.

CHANGES TO PRIVACY POLICY

Skyld reserves the right to modify this Privacy Policy to reflect changes to its practices and/or any Applicable Data Privacy Laws at any time. If there are any material changes, Skyld shall notify its users by email or by a notice on our website prior to the change becoming effective. You are encouraged to periodically review this webpage for the latest information on our privacy practices.
